BELMONT PARK 85TH ANNIVERSARY CONTEST OFFICIAL RULES

To provide a fair and equal chance of winning to all Wave House Belmont Park (“WHBP”) Entrants, the following are the official rules for the Belmont Park 85th Anniversary Contest.

1. BELMONT PARK 85TH ANNIVERSARY CONTEST (“Contest”). WHBP Entrants who enter the Contest as specified below, between July 1, 2010 and July 31, 2010, are eligible to win the prizes as explained below. For a Contest entry to count, it must be complete and submitted during the Contest dates. Entrants are solely responsible for complying with the Official Rules.
2. DETERMINATION OF PRIZE WINNERS. Two winners – each drawn at random from entries received-- will be announced on August 5, 2010 on the Belmont Park Website, and later notified individually by telephone and email. WHBP anticipates approximately 2,000 Entrants. If any winner is unreachable after 7 days after prize notification, or is unavailable for prize fulfillment, WHBP will consider the winner to have forfeited the prize, and an alternate winner will be selected at random from all remaining eligible entries received. All decisions are final and binding in all respects relating to this contest.
3. PRIZES.
   1. ONE (1) BELMONT PARTY for selected Prize Winner and seven (7) guests. The Belmont Party will include twenty (20) arcade tokens, access to The Plunge swimming pool, unlimited Vault Laser Maze Challenge, unlimited Glow Mini-Golf, pizza, and non-alcoholic beverages. This prize has an approximate value of US Two Hundred and Twenty-Five Dollars ($225); subject to availability, prize may be upgraded or exchanged for upon additional fees. If winner is a minor, then that winner's prize shall be awarded to and must be accepted by that Winner's parent or legal guardian.
   2. ONE (1) FLOW RIDER PARTY for selected Prize Winner and seven (7) guests. The Flow Rider Party will include a one-hour private party on the FlowRider® at Wave House, pizza, and non-alcoholic beverages. This prize has an approximate value of US Four Hundred and Ten dollars ($410); subject to availability, prize may be upgraded or exchanged for upon additional fees. If winner is a minor, then that winner's prize shall be awarded to and must be accepted by that Winner's parent or legal guardian.
   
   Belmont Party and Flow Rider Party must take place between August 15, 2010 and August 14, 2011, and is subject to availability of the Belmont Park and Wave House locations. Prizes are non transferable and cannot be redeemed for someone else. Prize winners are not entitled to any substitution or cash redemptions. WHBP reserves the right to substitute prizes of equal or greater value if a prize is unavailable at the listed approximate retail value. Each prize winner is responsible for all federal, state and local taxes associated with acceptance and use of the respective prize. Payment of any/all taxes is the sole responsibility of the prize winner. Each prize winner may be required to sign and return by mail within ten (10) days of receipt the Affidavit of Eligibility and Release and W-9 form (including social security number). If the prize winner fails to return these forms within the time required the prize will be forfeited. Prior to receiving a prize, each winner will be required to comply with the official rules and any regulations, specifically including but not limited to execution by prize winner of a liability waiver and release prior to receiving the prize.
4. NO PURCHASE REQUIRED. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING.
5. HOW TO ENTER. To enter the Contest, log on to www.BelmontPark.com, complete an entry form in its entirety, including name, zip code, telephone number, birthday, email address, and any other information requested on the entry form. Entrant can complete the entry form anytime between July 1, 2010 and July 31, 2010. Only online submissions will be accepted, entries are limited to one per person.
6. ELIGIBILITY. An entry can be denied for reasons including, but not limited to, any falsification of Entrant information or any other fraudulent activity. Incomplete, duplicate, or late entry forms will be void. WHBP is not responsible for any lost, late, illegible, incomplete, electronic miscommunications or failures, technical hardware or software failures of any kind, lost or unavailable network connections, or failed incomplete or delayed computer transmissions which may limit an entrant's ability to participate in the contest. Employees or agents of Wave House Belmont Park or its parent companies, affiliates, subsidiaries, advertising/promotional agencies, and the members of their immediate families or those persons living in the same household of such individuals are ineligible to win prizes. All federal, state and local laws and regulations apply. Void where prohibited by law. If any prize winner is a minor, then that winner's prize shall be awarded to and must be accepted by that Winner's parent or legal guardian.
7. CONDUCT. WHBP reserves the right to disqualify any Entrant for any reason WHBP deems appropriate, including, without limitation, if a Entrant has not complied with these Official Rules, or has interfered, in WHBP’s sole opinion, with the proper conduct of this Contest.
8. LIABILITY. Prize acceptance constitutes permission (except where prohibited) to use winner’s name and likeness for publicity purposes without compensation. WHBP and all its (and its parent companies’, affiliates’, subsidiaries’, successors’ and predecessors’) officers, members, directors, employees, contractors, representatives and agents shall have no liability and shall be held harmless by Entrants for any damage, loss of liability to persons or property, due in whole or in part, directly or indirectly by reason of the acceptance, possession, use or misuse of any prize or participation in this contest. WHBP reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend part or all of this Contest should unauthorized human intervention or other cause corrupt or impair the administration, security, fairness or proper operation of the Contest. WHBP and all its (and its parent companies’, affiliates’, subsidiaries’, successors’ and predecessors’) officers, members, directors, employees, contractors, representatives and agents are not responsible for fraud or for any technical or human error which may occur in the processing of submissions which may limit a Entrant’s ability to participate in the Contest or the results of the Contest. WHBP reserves the right at its sole discretion to disqualify any individual that WHBP reasonably believes to have tampered with the entry process or with the operation of the Contest, or who is found to be acting in violation of these Official Rules. This Contest is intended and limited for play in the United States and shall only be construed and evaluated according to laws of the State of California.
9. DISPUTE RESOLUTION; LIMITATION OF LIABILITY. Each Entrant agrees to release, defend, indemnify and hold harmless WHBP and all its (and its parent companies’, affiliates’, subsidiaries’, successors’ and predecessors’) officers, members, directors, employees, contractors, representatives and agents from any damage, injury, death, loss or other liability, either at law or equity, whether known or unknown, asserted or non-asserted, that may arise from or in any way relate to Entrant’s participation in the Contest or the awarding, acceptance, use or misuse of a prize. Any and all disputes, claims, and causes of action arising out of or in connection with this Contest shall be resolved individually, without resort to any form of class action. This Contest shall be governed by and construed in accordance with the laws of the State of California, regardless of principles of conflicts of laws that may require the application of the laws of another jurisdiction. Any action or litigation concerning this Contest shall be in the state court in and for San Diego County, California. Each Entrant expressly consents to the jurisdiction of and venue in such courts and waives all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. Each Entrant agrees to service of process by mail or other method acceptable under the laws of the state of California. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS CONTEST. ENTRANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEYS’ FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.
10. GENERAL CONDITIONS. This Contest is subject to all applicable Federal, State and local laws and regulations. By entering this Contest, each Entrant agrees to be bound by these Official Rules and the decisions of WHBP, and to accept delivery of a Prize based upon availability. In addition, each Entrant represents and warrants that all information contained in his or her entry is true and accurate. WHBP is not responsible for any printing or typographical errors in these Official Rules. WHBP reserves the right to cancel this Contest at any time and substitute another promotion in its place. This Contest is void where prohibited.
